| MMSEA New Law - Huge Penalties: Liability and Workers' Compensation Claims |
| Why is it that few attorneys and claims professionals are aware of Section 111 of the Medicare, Medicaid and SCHIP Extension Act of 2007? This new law, effective 1/1/08, requires all liability and workers' compensation insurance companies, self-insureds and others to register with the government beginning 5/1/09. The registration period has a 60-day window and closes on 6/30/09. Thereafter, every open claim must be reviewed and a lengthy questionnaire filled out for every eligible file, with submissions beginning 10/1/09. | Workers' Compensation Introduction to Disability and Rating |
| This seminar is designed for those individuals who have had little or no training in PD rating in preparation for taking the semester long courses in PD rating; CA 16A Permanent Disability Rating and the AMA Guides. Participants will learn the conceptual framework underlying disability and PD rating as well as an introduction to the mechanics of PD rating under the old and current PD schedules. You will learn how and what factors of disability a medical examiner is required to assess and how this information is used to calculate the extent of PD due the permanently injured worker. You will learn the individual components of the different rating formulas used in 1997 and 2005 PD rating schedules, and how these components interact to determine the extent of PD. Significant changes have been made to Wrap Up policies (OCIPs, CCIPs, etc.) effective January 1, 2009 for the risks and obligations of the participants, especially for residential construction. These changes are a result of California's new legislation contained in AB2738. As a result, there is a need for changes in Contractual Agreements, Indemnity, and Insurance coverages.
